TERMS AND CONDITIONS – SAVOR & SMOKE

1. General
These Terms and Conditions apply to all offers, orders and agreements between Savor & Smoke and customers through the Savor & Smoke webshop.
Savor & Smoke sells food products, including hot sauces and related products, through its online store.
By placing an order through our webshop, you agree to these Terms and Conditions.
These Terms and Conditions do not affect any mandatory statutory rights that consumers have under Dutch or European law.

3. Products and product information
We make every reasonable effort to ensure that the information, descriptions, images and prices displayed in our webshop are accurate and up to date.
Minor differences in colour, appearance or presentation may occur between products shown on the website and the products delivered.
Our products are food products and should be stored and used according to the instructions stated on the product label.
Customers are responsible for checking the product label and ingredient/allergen information before consumption, particularly where they have allergies or dietary restrictions.
4. Prices
All prices displayed in our webshop are in euros (€) and include VAT where applicable.
Shipping costs are displayed separately before the customer completes the order.
Savor & Smoke reserves the right to change prices, promotions and offers. The price applicable to an order is the price displayed at the time the order is placed.
If a clear pricing error occurs on the website, Savor & Smoke reserves the right to correct the error and, where legally permitted, cancel the affected order.
5. Orders and acceptance
By placing an order, the customer makes an offer to purchase the selected products.
After placing an order, the customer will receive an order confirmation by email.
The purchase agreement is concluded when Savor & Smoke confirms acceptance of the order.
Savor & Smoke reserves the right to refuse or cancel an order where there is a legitimate reason, including circumstances involving incorrect pricing, suspected fraud, product unavailability or technical errors.
If an order is cancelled after payment has been received, the amount paid for the cancelled order will be refunded.
6. Payment
Payment must be completed using the payment methods made available in the webshop.
The available payment methods and any applicable costs are displayed during the checkout process.
An order will normally be processed after successful payment.
7. Delivery
We deliver to the delivery address provided by the customer during checkout.
Delivery times displayed on the website are estimates unless a specific delivery date has been expressly agreed.
Savor & Smoke will make reasonable efforts to dispatch orders within the indicated processing time.
Once an order has been handed to the delivery carrier, delays caused by the carrier or circumstances outside Savor & Smoke's reasonable control may occur.
If an order is significantly delayed or cannot be delivered, Savor & Smoke will inform the customer and, where required by law, provide the customer with the applicable rights and remedies.
8. Delivery address
The customer is responsible for providing a complete and accurate delivery address.
If a parcel cannot be delivered because the customer provided an incorrect or incomplete address, additional delivery costs may apply where legally permitted.
9. Right of withdrawal for consumers
Consumers purchasing products online generally have a statutory right of withdrawal of 14 days.
The withdrawal period normally starts on the day after the customer, or a third party designated by the customer, receives the products.
The customer does not have to provide a reason for exercising the right of withdrawal.
The right of withdrawal can be exercised using the online withdrawal function where available, by email, or by using the statutory withdrawal form.
The customer may also contact Savor & Smoke directly using the contact details provided in these Terms and Conditions.
Where the law provides an exception to the right of withdrawal, that exception will apply and will be communicated to the customer where required.
Products that deteriorate quickly or are otherwise legally excluded from the right of withdrawal are not eligible for withdrawal.
10. Returning products after withdrawal
If a consumer validly exercises the right of withdrawal, the customer must return the relevant products without undue delay and no later than 14 days after communicating the withdrawal.
Unless otherwise required by law, the customer is responsible for the direct cost of returning the products.
Products should be returned appropriately packaged and, where reasonably possible, in their original condition.
The customer is responsible for any diminished value resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.
11. Refunds
After a valid withdrawal, Savor & Smoke will refund the amounts that are legally required to be refunded.
Where applicable, this includes the original standard delivery costs.
If the customer selected a more expensive delivery method than the cheapest standard delivery option offered by Savor & Smoke, the additional delivery cost does not have to be refunded.
Refunds will normally be made using the same payment method used for the original transaction.
Savor & Smoke may wait with the refund until the returned products have been received or the customer has provided evidence that the products have been sent back, whichever occurs first, where permitted by law.
12. Damaged, incorrect or defective products
Savor & Smoke is responsible for ensuring that products conform to the agreement and meet the reasonable expectations of the customer.
If a customer receives a damaged, defective, incorrect or otherwise non-conforming product, the customer should contact Savor & Smoke as soon as reasonably possible at:

Savor & Smoke will work with the customer to find an appropriate solution in accordance with applicable consumer law.
Nothing in these Terms and Conditions limits the customer's statutory rights regarding defective or non-conforming products.
13. Food safety and storage
Savor & Smoke products must be stored and handled according to the instructions on the product label.
Customers should always check the product label before consuming the product.
Savor & Smoke cannot be held responsible for problems caused by incorrect storage, handling or use of a product after delivery.
14. Allergens and ingredients
Ingredient and allergen information applicable to each product is provided on the product packaging and/or product page.
Customers with food allergies or intolerances should carefully review the ingredient and allergen information before ordering and consuming a product.
If a customer is uncertain about the suitability of a product, they should contact Savor & Smoke before consuming it.

Savor & Smoke will make reasonable efforts to respond to complaints as soon as possible and work toward an appropriate solution.
16. Business customers (B2B)
Business customers purchasing products for professional or commercial purposes are not considered consumers under these Terms and Conditions.
The statutory consumer right of withdrawal does not apply to B2B purchases unless otherwise agreed in writing.
For B2B orders, the agreed quotation, order confirmation and any separately agreed commercial terms apply.
17. Intellectual property
All content published on the Savor & Smoke website, including logos, brand names, photographs, product images, graphics, text, recipes, designs and other materials, belongs to Savor & Smoke or is used with permission.
This content may not be copied, reproduced, modified, distributed or commercially used without prior written permission from Savor & Smoke, except where permitted by law.
18. Privacy
The processing of personal data is governed by our Privacy Policy.
The Privacy Policy explains what personal data we collect, why we collect it, how we use it and what rights customers have regarding their personal data.
19. Changes to these Terms and Conditions
Savor & Smoke may update these Terms and Conditions from time to time.
The version applicable to an order is the version that was available at the time the order was placed, unless a change is required by mandatory law.
The current version will be published on the Savor & Smoke website.
20. Applicable law
These Terms and Conditions and agreements between Savor & Smoke and consumers are governed by Dutch law, without prejudice to mandatory consumer protection rules that apply in the consumer's country of residence.
For disputes involving consumers, the mandatory jurisdiction rules under applicable consumer law apply.
For B2B agreements, Dutch law applies unless otherwise agreed in writing.
